These Terms & Conditions govern access to cavistaar.in, submission of enquiries and professional-service engagements coordinated through CA Vistaar.

Introduction

These Terms & Conditions constitute an agreement between the person or entity using this website or requesting services, referred to as “you”, “your” or “client”, and CA Vistaar, referred to as “CA Vistaar”, “we”, “us” or “our”.

These terms apply to use of cavistaar.in, website enquiries, consultations, quotations, service orders and professional service coordination undertaken through CA Vistaar.

A separate quotation, engagement confirmation, invoice, email, WhatsApp message or written scope may contain additional terms. Where a specific written service agreement conflicts with these general terms, the specific written agreement will apply to that service.

Acceptance of Terms

Your agreement when accessing the website or requesting services.

By accessing this website, submitting an enquiry, requesting a quotation, making payment or instructing us to begin work, you confirm that you have reviewed and accepted these Terms & Conditions and our Privacy Policy.

Do not use the website or purchase a service where you do not agree with these terms.

Eligibility and Authority

You must have authority to submit information and request services.

  • You must be legally capable of entering into a binding agreement.
  • You must provide complete, accurate and current information.
  • You must have authority to act for any business, company, LLP, firm or individual represented by you.
  • Where the service concerns a minor, the request must be made by a parent, guardian or authorised representative.
  • You must not impersonate another person or provide documents without lawful authority.
We may request identity, authorisation or business verification before accepting or continuing a service.

Service availability depends on eligibility, complexity, documents, professional requirements, applicable law and available resources.

Service Engagement and Scope

An enquiry does not automatically create a professional engagement.

Submission of a website form, phone call, WhatsApp message or email does not by itself create a professional engagement.

A service will be treated as accepted only after one or more of the following occurs:

  • The scope and charges are confirmed in writing.
  • A quotation or service proposal is accepted.
  • The requested advance or full payment is received.
  • Required documents and information are received.
  • We expressly confirm commencement of the assignment.
Scope limitation: Work outside the confirmed scope may require a separate quotation, revised timeline and additional payment.

Client Responsibilities

Timely and accurate cooperation is necessary for service delivery.

You agree to:

  • Provide accurate, complete and current information.
  • Provide documents within the requested timeline.
  • Review drafts, computations, forms and filings before approval.
  • Inform us promptly of errors, changes or missing information.
  • Maintain lawful ownership or authority over submitted documents.
  • Pay applicable professional charges, taxes and government fees.
  • Keep passwords, OTPs, digital signatures and portal credentials secure.
  • Respond promptly where government or professional deadlines apply.
  • Comply with applicable tax, corporate and other legal obligations.
CA Vistaar will not be responsible for penalties, rejection or delay caused by incorrect information, missing documents, late instructions, unavailable client approval or failure to make required payments on time.

Documents and Information

Documents must be genuine, readable and lawfully supplied.

You confirm that all documents and information supplied to us are genuine, complete, accurate and lawfully obtained.

  • Documents must be clear and readable.
  • Scanned copies may be accepted for initial processing.
  • Original, certified or digitally signed documents may be required for specific services.
  • We may refuse altered, suspicious, incomplete or inconsistent documents.
  • We may request additional clarification or supporting evidence.
Do not share passwords, OTPs, debit-card PINs or internet banking credentials. Where portal access is required, follow the approved and secure process communicated to you.

Professional Fees and Payments

Charges depend on the selected service and assignment complexity.

Professional charges may be communicated through a quotation, invoice, email, WhatsApp message or other written confirmation.

  • Payment may be required fully or partly in advance.
  • Work may begin only after confirmation of payment.
  • Additional work outside the confirmed scope may attract additional fees.
  • Urgent or priority processing may have separate charges.
  • Third-party and government charges are separate unless expressly included.
  • Bank, payment-gateway or transaction charges may apply.

Where payment is delayed, we may pause work, withhold deliverables or revise the expected completion timeline.

Taxes, Government Fees and Third-Party Charges

External charges are payable according to applicable requirements.

Professional charges may be exclusive of applicable taxes, government fees, stamp duty, statutory charges, portal fees, courier charges, notarisation charges and third-party expenses unless expressly stated otherwise.

Third-Party Professional Cost Payable where external assistance, certification or verification is required. May become non-refundable after the third party is instructed.

Cancellation and Refund Policy

Refund eligibility depends on work completed and costs incurred.

Cancellation Before Work Begins

Where you cancel before substantive work begins, a refund may be considered after deducting payment-gateway charges, consultation charges, administrative costs and any third-party or government amount already paid.

Cancellation After Work Begins

Once document review, preparation, consultation, drafting, filing, verification, registration processing or other substantive work has begun, professional charges relating to completed or committed work may be non-refundable.

Non-Refundable Amounts

  • Government or statutory fees already paid.
  • Payment-gateway and banking charges.
  • Third-party professional or verification charges.
  • Consultation charges already utilised.
  • Charges for completed work or prepared deliverables.
  • Urgent-processing charges after priority work begins.
  • Penalties, interest or late fees payable to authorities.

Duplicate or Excess Payment

A verified duplicate or excess payment will be refunded to the original payment method or another verified account, subject to transaction checks and applicable deductions.

Cancellation by CA Vistaar

Where we are unable to accept or continue a service for reasons not caused by the client, any unearned professional fee may be refunded after deducting completed work and unavoidable costs.

Refund requests should be sent to info@cavistaar.in with payment details, service name and the reason for the request.

Service Timelines

Timelines are estimates and depend on several external factors.

Any timeline communicated by CA Vistaar is an estimated processing timeline unless expressly confirmed as fixed in writing.

Timelines may be affected by:

  • Incomplete or incorrect documents.
  • Delay in client approval or response.
  • Government-portal availability.
  • Authority processing time.
  • Clarifications, objections or additional-document requests.
  • Changes in law, forms, portal systems or procedures.
  • Public holidays, technical issues or extraordinary events.
Government approval, registration, refund or processing time is controlled by the relevant authority and cannot be guaranteed by CA Vistaar.

Government Portals and Regulatory Decisions

Authorities independently control approvals and statutory outcomes.

Our role may include preparation, coordination or submission based on the information and documents provided by you.

CA Vistaar does not control:

  • Government portals and their technical availability.
  • Application approval or rejection.
  • Tax refunds, assessments or scrutiny selection.
  • Processing time of government departments.
  • Requests for additional documents or clarification.
  • Changes in government procedures, forms or fees.
  • Actions of banks, payment providers or third-party authorities.
No employee, representative, website statement or communication should be interpreted as a guarantee of registration, approval, refund, tax saving or favourable regulatory outcome.

Electronic Communication and Consent

Communication may occur through the contact details supplied by you.

You agree that service-related communication may be sent through phone call, WhatsApp, RCS, SMS, email or other reasonable electronic channels.

Promotional Communication

Promotional communication may be sent where applicable consent or lawful permission exists. You may withdraw promotional consent by contacting info@cavistaar.in or using an available opt-out facility.

Withdrawal of promotional consent will not prevent necessary communication regarding an active enquiry, payment, service, filing, compliance deadline, support issue or legal requirement.

Electronic Records

You agree that confirmations, invoices, approvals, instructions and records communicated electronically may be treated as valid business communications.

Confidentiality and Privacy

Information is handled according to the service and privacy requirements.

We seek to maintain reasonable confidentiality of documents and information received for an agreed service.

Information may be shared where reasonably necessary with:

  • Professionals involved in the assignment.
  • Authorised staff and service providers.
  • Government and regulatory authorities.
  • Payment, hosting, cloud and communication providers.
  • Auditors, legal advisers and professional consultants.
  • Competent authorities acting under lawful powers.

Personal information is handled according to our Privacy Policy.

Intellectual Property

Website material and proprietary documents remain protected.

The website design, branding, text, graphics, layout, service descriptions, templates and original materials belong to CA Vistaar or their respective licensors.

You must not, without written permission:

  • Copy or republish substantial website content.
  • Use the CA Vistaar name or branding deceptively.
  • Resell proprietary templates or internal documents.
  • Modify materials to misrepresent their source.

Client-owned documents remain the client’s property. General knowledge, methods, working formats and non-confidential templates used in providing services may remain the property of CA Vistaar or the relevant professional.

Prohibited Use

The website and services must be used lawfully.

You must not use our website or services to:

  • Submit forged, altered or misleading records.
  • Evade tax, conceal income or facilitate unlawful activity.
  • Impersonate another person or entity.

Suspension and Termination

Services may be paused or ended in defined circumstances.

We may pause, refuse or terminate a service where:

  • Payment remains outstanding.
  • Required documents or approvals are not provided.
  • Information appears incorrect, suspicious or unlawful.
  • The requested work creates legal, ethical or professional concerns.
  • There is abusive, threatening or inappropriate conduct.
  • The client repeatedly fails to respond.
  • Continuing the assignment is not reasonably possible.
  • Applicable law, authority direction or professional requirements prevent continuation.

Fees for work already completed and costs already incurred remain payable. Client documents may be returned, deleted or retained according to applicable legal and record-keeping requirements.

Limitation of Liability

Liability is limited to the extent permitted by applicable law.

To the extent permitted by applicable law, CA Vistaar will not be liable for indirect, incidental, special, punitive or consequential loss, including loss of profit, revenue, opportunity, business, goodwill or data.

We will not be responsible for loss caused by:

  • Incorrect or incomplete information supplied by the client.
  • Late client response, approval or payment.
  • Government-portal or third-party service failure.
  • Authority rejection, processing delay or policy change.
  • Unauthorised access caused by compromised client credentials.
  • Events beyond our reasonable control.
  • Client action taken contrary to our written communication.

Subject to applicable law, any direct aggregate liability arising from a specific paid service will ordinarily not exceed the professional fee actually paid to CA Vistaar for that specific service giving rise to the claim.

Nothing in these terms excludes or restricts liability that cannot lawfully be excluded under applicable law.

Indemnity

Clients remain responsible for unlawful or unauthorised conduct.

To the extent permitted by law, you agree to indemnify and hold CA Vistaar, its personnel and service providers harmless from claims, losses, penalties or expenses arising from:

  • False, forged, misleading or unauthorised information supplied by you.
  • Your breach of these Terms & Conditions.
  • Your violation of law or third-party rights.
  • Instructions issued without proper authority.
  • Misuse of deliverables, filings or professional communications.

Force Majeure

Neither party is responsible for events beyond reasonable control.

CA Vistaar will not be responsible for delay or failure caused by events beyond reasonable control, including:

  • Natural disasters, floods, fire or severe weather.
  • War, terrorism, civil disturbance or government restriction.
  • Internet, electricity, server or telecommunications failure.
  • Government-portal outage or system maintenance.
  • Cyberattack, malware or widespread technical incident.
  • Public-health emergency, strike or transportation disruption.
  • Sudden regulatory or procedural change.

Performance timelines may be extended for the duration reasonably required to manage such circumstances.

Governing Law and Jurisdiction

These terms are governed by applicable Indian law.

These Terms & Conditions are governed by the laws applicable in India.

The parties should first attempt to resolve any concern through good-faith written communication.

Subject to applicable consumer law and mandatory legal jurisdiction, courts having jurisdiction in Palghar, Maharashtra will have jurisdiction over disputes relating to these terms or services provided by CA Vistaar.

Severability

Where any provision is held invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permitted.

No Waiver

Failure to enforce a provision immediately will not constitute a permanent waiver of that provision.

Updates to Terms

We may update these terms to reflect service, operational or legal changes. The latest version will be published on this page with a revised effective date.
